Marketplace Terms

1. Overview

The Fisho Premium Marks Marketplace ("Marketplace") allows users to buy and sell fishing location data ("Premium Marks") through the Fisho platform. By using the Marketplace, you agree to these terms in addition to the main Fisho Terms of Service.

2. What You're Purchasing

When you purchase a Premium Mark, you are purchasing a non-exclusive, non-transferable licence to access GPS coordinates and associated fishing knowledge provided by the seller.

• You are not purchasing a guarantee of fishing success.
• Fishing conditions, regulations, and fish behaviour vary and are beyond the control of Fisho or the seller.
• The licence is for your personal use only. You may not share, resell, or redistribute the purchased coordinates.

3. Refund Policy

Due to the nature of digital location data:

• No refunds are available once GPS coordinates have been revealed to the buyer.
• Lack of fishing success at a purchased location does not constitute grounds for a refund.
• Refunds may be issued at Fisho's sole discretion in cases of clear fraud or invalid data (e.g., coordinates pointing to dry land or inaccessible private property).

4. Seller Obligations

• Sellers must provide accurate GPS coordinates that correspond to legitimate, accessible fishing locations.
• Sellers must not list coordinates for restricted, private, or illegal fishing locations.
• Sellers set their own prices and are responsible for the quality of information provided.
• Sellers receive payment minus a platform commission, processed via Stripe Connect.
• Sellers are responsible for any applicable tax obligations on their earnings.

5. Buyer Obligations

• Buyers must comply with all local fishing regulations when using purchased coordinates.
• Purchased coordinates are for personal use only and must not be shared or redistributed.
• Buyers are encouraged to leave honest reviews to help maintain marketplace quality.

6. Platform Commission

Fisho charges a platform commission on each sale. The commission rate is displayed to sellers during the listing creation process. Payments are processed securely via Stripe and sellers receive payouts directly to their nominated bank account via Stripe Connect.

7. Content Moderation

Fisho reserves the right to remove listings, suspend sellers, or take other action to maintain marketplace quality. Sellers with consistently poor reviews, fraudulent listings, or violations of these terms may be permanently removed from the marketplace.

8. Limitation of Liability

Fisho acts as a platform connecting buyers and sellers. We do not verify the fishing quality of listed locations. Fisho is not liable for any loss, injury, or damage arising from the use of purchased Premium Marks, including but not limited to fishing outcomes, travel costs, or equipment damage.

9. Disputes

In the event of a dispute between a buyer and seller, Fisho may mediate at its discretion. Fisho's decision on any dispute is final. For fraud or invalid data reports, contact support@fisho.app.
