1. Introduction

Welcome to Fisho! These Terms of Service ("Terms") govern your use of the Fisho mobile application, website, and any related services (collectively, the "Service"), operated by Fisho ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

2. Definitions

• App: The Fisho mobile application available on iOS and Android platforms.
• Content: Any information, text, graphics, photos, videos, location data, fish catches, or other materials uploaded, downloaded, or appearing on the Service.
• User: Any individual who accesses or uses the Service.
• Subscription: Premium access to additional features of the Service available for purchase.

3. User Accounts

3.1 Account Creation

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

3.2 Account Security

You are responsible for safeguarding the password and credentials used to access the Service and for any activities or actions under your account. We recommend using a strong, unique password and enabling two-factor authentication when available.

3.3 Age Restrictions

The Service is intended for users who are at least 13 years of age. By accessing or using the Service, you confirm that you are at least 13 years old. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the Service.

4. User Content

• To attempt to gain unauthorized access to the Service, other users' accounts, or computer systems or networks connected to the Service.
• To transmit any material that contains viruses, trojan horses, worms, or any other malicious or harmful code.

6. Fishing Regulations and Ethics

6.1 Compliance with Local Laws

Users are responsible for complying with all local, state, and federal fishing regulations, including but not limited to licensing requirements, catch limits, size restrictions, and seasonal closures.

6.2 Ethical Fishing Practices

We encourage ethical fishing practices, including catch and release when appropriate, proper fish handling, and respect for the environment and other anglers.

6.3 Location Information

While the Service may provide information about fishing locations, it is the user's responsibility to ensure they have legal access to these locations and are not trespassing on private property.

7. Subscriptions and Payments

7.1 Subscription Options

We offer subscription plans that provide access to premium features. By purchasing a subscription, you agree to pay the applicable fees as they become due.

7.2 Billing

All payments are processed through third-party payment processors. By providing payment information, you represent that you are authorized to use the payment method and agree to the terms of the payment processor.

7.3 Subscription Cancellation

You may cancel your subscription at any time through your device's app store account settings. Cancellation will take effect at the end of your current billing period.

7.4 Refunds

Refunds are handled in accordance with the policies of the app store through which you purchased the subscription. We do not directly process refunds for subscription purchases.

8. Intellectual Property

8.1 Service Content

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Fisho and its licensors.

8.2 Trademarks

The Fisho name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Fisho or its affiliates. You may not use such marks without our prior written permission.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and disclose information about you.

10. Limitation of Liability

To the maximum extent permitted by law, in no event shall Fisho, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.

11. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Fisho expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no warranty that:

• The Service will meet your requirements.
• The Service will be uninterrupted, timely, secure, or error-free.
• The results that may be obtained from the use of the Service will be accurate or reliable.
• The quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations.

12. Indemnification

You agree to defend, indemnify, and hold harmless Fisho, its directors, employees, partners, agents, suppliers, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

13. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account through the app settings.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page and updating the "Last Updated" date.

Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Fisho is established, without regard to its conflict of law provisions.

By using Fisho, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
