These Terms of Service apply to purchases from https://fisho.app and to the sale of Fisho hardware products by MASEA AU PTY LTD trading as FISHO TECHNOLOGIES, ACN 699 354 357.

By placing an order, you agree to these terms.

Products

Atlas Mini is a connected marine electronics product that links supported boat data with the Fisho app.

Product features can depend on:

• your boat network
• installed sensors
• Wi-Fi and internet availability
• app version
• firmware version
• compatible NMEA 2000 equipment
• setup and installation quality

We try to keep product information accurate. If we discover an error in price, availability, description, or specification, we may correct it and contact you about any affected order.

Orders

Your order is an offer to buy the product at the displayed price.

We may accept or reject an order for reasonable reasons, including:

• payment failure
• suspected fraud
• stock error
• pricing error
• shipping address issue
• compliance or supply issue

If we reject an order after payment has been taken, we will refund the amount paid.

Pricing And GST

Prices are shown in Australian dollars unless stated otherwise.

GST treatment will be shown at checkout where applicable.

Shipping costs, if any, are shown at checkout before you place the order.

Payment

Payment is processed through Shopify and its payment providers.

We do not store full card details on our systems.

Pre-Orders And Backorders

Atlas Mini units may be made to order during the founder/pilot release. Made-to-order units may take up to 10 business days from order confirmation before dispatch.

If a product is sold as a pre-order or backorder, the product page will show the expected dispatch timing.

Estimated dates are estimates only. If there is a material delay, we will update you.

You may cancel a pre-order before dispatch for a refund unless the product page clearly states different terms for a custom or special-order item.

Shipping

Shipping is handled under our Shipping Policy.

Delivery times are estimates and can be affected by carriers, weather, remote locations, public holidays, or incorrect address details.

Returns, Refunds, And Consumer Guarantees

Returns and refunds are handled under our Return and Refund Policy.

Nothing in these terms limits your rights under the Australian Consumer Law.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Installation And Use

You are responsible for making sure Atlas Mini is suitable for your intended use and installation.

Atlas Mini should be installed and used according to the product documentation.

If you are not confident with marine electronics, NMEA 2000 networks, wiring, or mounting, use a competent marine installer.

Do not install or use Atlas Mini in a way that could interfere with required vessel safety equipment, navigation equipment, communications equipment, or manual vessel controls.

Important Limitations

Atlas Mini is not a replacement for:

• vessel instruments
• chartplotters
• navigation equipment
• safety equipment
• emergency beacons
• marine radios
• watchkeeping
• skipper judgement

Remote features require power, Wi-Fi, internet access, app/cloud availability, and correct setup. Alerts and notifications may be delayed, unavailable, or affected by network conditions.

Digital switching/control features must only be used with supported systems and explicitly configured safe circuits.

NMEA 2000 And Compatibility

Atlas Mini is designed for supported NMEA 2000 networks.

Unless we expressly state otherwise in writing, do not treat Atlas Mini as NMEA 2000 certified.

Compatibility depends on the boat network, sensors, device configuration, firmware, and supported PGNs/features.

App, Cloud, And Updates

Some features require the Fisho app, a Fisho account, cloud services, firmware updates, or internet access.

We may release firmware or app updates to improve reliability, security, compatibility, or features.

Some features may change over time as the product, app, cloud, or third-party services change.

Accounts And Security

You are responsible for keeping your Fisho account secure.

Do not share setup codes, recovery passwords, pairing tokens, or account credentials.

If you sell or transfer a device, remove it from your account and factory reset it first.

Privacy

We handle personal information under our Privacy Policy.

Atlas Mini and Fisho may handle device, boat, trip, location, telemetry, support, and account data.

Intellectual Property

Fisho, Atlas Mini, product designs, software, firmware, documentation, website content, graphics, and branding are owned by us or licensed to us.

You may not copy, reverse engineer, resell, or commercially exploit our software, firmware, documentation, or branding except as permitted by law or agreed in writing.

Acceptable Use

You must not:

• tamper with product security
• attempt unauthorised access to Fisho systems
• use Atlas Mini for unlawful purposes
• use Atlas Mini to interfere with vessel safety systems
• misrepresent product certification or approval status
• resell modified products without written permission

Liability

To the maximum extent permitted by law, we are not liable for indirect, special, incidental, or consequential loss arising from use of the website, product, app, cloud services, or support.

Nothing in these terms excludes, restricts, or modifies any right, guarantee, remedy, or liability that cannot be excluded under Australian Consumer Law.

Changes To These Terms

We may update these terms from time to time.

The version that applies to your order is the version published at the time you place the order, unless a change is required by law.

Governing Law

These terms are governed by the laws of Queensland, Australia.
